US federal prosecutors are pushing for a lengthy prison sentence for Avraham \”Avi\” Eisenberg, the individual behind the infamous $110 million Mango Markets exploit in 2022. Their recommendation? A minimum of six and a half years.

In a filing submitted to US District Judge Arun Subramanian on April 22nd, ahead of Eisenberg’s May 1st sentencing hearing, prosecutors advocate for a sentence ranging from 78 to 97 months. This follows Eisenberg’s April 2024 conviction on charges of wire fraud, commodities fraud, commodities manipulation, and possession of child pornography.

Court documents reveal the prosecution’s rationale: the severity of Eisenberg’s crimes, the need to uphold the law, deter future criminal behavior, and protect the public. The sheer scale of the fraud – over $100 million – is highlighted as a significant aggravating factor, warranting a substantial penalty.

The impact of Eisenberg’s actions extends beyond the immediate financial loss. Mango Markets, launched in August 2021, ceased operations in January 2023, a direct consequence of the exploit. While Eisenberg returned approximately $67 million, over $40 million remains unaccounted for following a community governance vote.

Eisenberg’s defense argued the exploit was a legitimate trading strategy, a claim rejected by the court. Mango Markets, in their own filing, seeks $47 million in restitution, aiming to fully compensate all affected parties, including the DAO itself.

The sentencing, initially scheduled for December 2024, has faced several postponements due to the complexities of the case, finally settling on May 1st. The outcome of this sentencing will serve as a significant precedent in the evolving legal landscape of cryptocurrency crime.
